SB458 would legally define only two sexes - male and female - and determine them by their respective reproductive biologies apparent at birth. It was referred to the Judiciary committee on March 22, 2023.

SB-458 passed the House (60-36) yesterday (Apr 21). This bill does not allow for consideration of "biologic or genetic condition" [Governor Gianforte's wording] when determining a person't sex. It ignores current scientific evidence which allows for a spectrum of sexuality.
It will go to the Governor for signature soon. Again, it is most likely destined for an expensive Supreme Court case. It is another in a group of bills that were imported into Montana's legislature from a National Agenda. It makes me sad. Montana used to be known for it's independent thinking. And, a key Montana Value was to "live and let live," but to offer a helping hand if one was needed.
